These Terms of Service (hereinafter, "the Terms") govern access to and use of the Epical Tune Records digital platform (hereinafter, "the Label") available at epicaltune.com and associated applications.

Epical Tune Records is an independent record label specializing in electronic music, founded in 2020, dedicated to the distribution, production, promotion and comprehensive management of artists in genres such as EDM, Electro, House, Minimal, Techno and their derivatives.

These Terms constitute a legally binding agreement between you and Epical Tune Records. By accessing or using the Platform, you declare that you have read, understood and fully accepted these Terms.

By signing up, accessing or using the Platform, you confirm that:

• You are at least 18 years old or of legal age in your jurisdiction.
• You have the legal capacity to enter into binding agreements.
• The information you provide is truthful, accurate and up to date.
• You will not use the Platform for any illegal or unauthorized purpose.

• You are responsible for keeping your login credentials confidential.
• You are responsible for all activity carried out under your account.
• You must notify us immediately if you suspect unauthorized access.
• You may not transfer, assign or share your account with third parties.
• Each person may maintain only one active account.

We reserve the right to suspend or delete accounts that violate these Terms, provide false information or pose a security risk.

Epical Tune Records offers the following services, subject to availability and the specific conditions of each:

Specific conditions, prices, timelines and deliverables are detailed at the time of quotation and/or in individual contracts, which prevail over these general Terms in case of conflict.

• Prices: expressed in the currency indicated in the quotation. We may update them without affecting services already purchased and paid for.
• Processing: payments are processed through certified, secure gateways. We do not store credit or debit card data.
• Refund policy: evaluated case by case. For technical services already started, no refund applies except for non-performance attributable to the Label. For campaigns already executed, no refunds apply for advertising spend on external platforms.
• Royalties: split percentages and conditions are set out in the individual contract. Subject to agreed minimum withdrawal amounts.
• Disputes: must be reported within 30 days of the transaction. After that period, the charge is considered accepted.

Your rights: the artist retains ownership of the copyright in their compositions and recordings at all times, unless the specific contract states otherwise.

License to the content you upload: by uploading material to the Platform, you grant us a non-exclusive, royalty-free, revocable license, solely for the technical purposes of processing and delivering the purchased service.

The Label's rights: the name "Epical Tune Records", its logo, brand and all elements of the Platform are the exclusive property of the Label and are protected by intellectual property laws.

Artist warranties: by uploading or distributing content, you declare that you own it or hold the necessary licenses; that the content does not infringe third-party rights; and that you have the required permissions for samples and third-party material included in your production.

Any third-party claim for infringements related to your content will be your sole responsibility.

By using the Platform, you agree not to:

• Distribute content that infringes copyright, trademarks or other intellectual property rights.
• Upload material containing samples without proper authorization or license.
• Attempt unauthorized access to other accounts, systems or networks.
• Use automated tools, bots or scrapers to extract data.
• Impersonate another person, artist or entity.
• Distribute illegal, defamatory, obscene content, or content that incites hatred or violence.
• Create multiple accounts to evade prior restrictions or sanctions.
• Interfere with the normal operation of the Platform or its security systems.

To the maximum extent permitted by law, Epical Tune Records shall not be liable for indirect, incidental, special, consequential or punitive damages. In particular, we assume no responsibility for:

• Streaming platform decisions regarding acceptance, positioning or monetization of content.
• Variations in the results of digital marketing campaigns.
• Service interruptions due to force majeure or failures in third-party services.
• Content ID actions or rights claims on YouTube arising from the artist’s content.
• Loss of income due to rights disputes originating from the artist’s content.

Epical Tune Records' maximum liability shall be limited to the total amount you have paid in the 12 months prior to the event giving rise to the claim.

Term: these Terms remain in force as long as you maintain an active account or use any service.

Termination by the user: you may request the deletion of your account at any time. Deletion does not retroactively cancel current distribution contracts, which continue under their own terms until expiration.

Termination by the Label: we may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, upload content that infringes third-party rights, or your use puts the security of the Platform at risk. In serious cases, we may proceed without prior notice.

We may modify these Terms at any time. For material changes, we will give at least 15 days' notice by email and/or a prominent notice on the Platform, unless the modification is urgent for legal or security reasons.

Continued use after the effective date will constitute your acceptance of the changes.

These Terms are governed by the laws of the Republic of Colombia, including Law 527 of 1999 (electronic commerce) and Law 1480 of 2011 (Consumer Statute).

Amicable resolution: in the event of any dispute, the parties will attempt to resolve it amicably within 30 days of notification of the conflict.

Jurisdiction: if no agreement is reached, disputes will be submitted to the competent courts of Colombia. If any provision is declared invalid, the remaining provisions will remain in force.
